Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your use of the Cutmaxx mobile app, this website and related services (the "Service"), operated by Stanislav Pavlenko ("we", "us").

By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old, or the minimum age at which you can consent to the processing of your personal data in your country if that is higher (for example 16 in Germany and Poland, 15 in France, 14 in Spain and Italy). If you are under 18, you may use the Service only with the permission of a parent or guardian. You confirm that you meet these requirements.

3. What the Service is

Cutmaxx estimates your face shape from a photo and suggests haircuts and beard styles, and can generate AI images that preview a style on your photo.

Face-shape results and recommendations are general style guidance, not professional advice, and can be affected by lighting, pose and hair. Try-on images are AI previews: they may differ from how a style would really look, and your actual result depends on your hair and your barber or hairdresser. We are not responsible for the result of any haircut or grooming decision.

4. Photos you use

Only use photos of yourself. Do not upload photos of other people or photos you do not have the right to use.

Do not use the Service to create misleading, sexual, hateful or harassing images, or to impersonate anyone. We may refuse a try-on or suspend accounts that break these rules.

You keep the rights to your photos. You give us a limited licence to store and process them only to provide the Service to you. You may use the generated images of yourself for personal purposes.

5. Subscriptions and purchases

Try-ons are paid for, billed through the Apple App Store or Google Play. Prices are shown in the app before you buy. The face-shape analysis and the style catalog are free.

Try-on packs are one-time purchases. Pack try-ons stay on your account until you use them; they do not expire.

Cutmaxx Pro is a subscription (weekly, monthly or yearly) that includes a number of try-ons for each period, shown in the app before you buy (for yearly plans, per month). Unused Pro try-ons do not carry over to the next period. Pack try-ons are used only after the period's Pro try-ons, and are never removed when a period ends or a subscription is cancelled. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you manage and cancel them in your store account settings.

A try-on that fails is never counted. To keep the Service available and prevent automated abuse, Pro try-ons are limited to 40 per day; the limit resets at midnight UTC.

Refunds follow the policies of Apple or Google, except where the law requires otherwise.

6. Privacy

Our Privacy Policy at https://llm-chats-4q11wohlw-pavlenkosts-projects.vercel.app/privacy explains how we handle information, including that face-shape analysis runs on your device. It forms part of these Terms.

7. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, TO THE EXTENT PERMITTED BY LAW. Nothing in these Terms limits rights you have as a consumer that cannot be excluded under the law of your country.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $50.

9. Changes and termination

We may update these Terms and will post the new version here with a new "Last updated" date. You may stop using the Service and delete your account at any time.

10. Governing law

These Terms are governed by the laws of the operator's place of business, without prejudice to mandatory consumer protection laws of your country of residence.
